A court in New Mexico has mandated that Meta must contribute $567 million to a fund designed to mitigate the alleged mental health impacts its social media platforms have on children. This decision comes in the wake of a March jury finding that determined Meta was aware of and contributed to the mental health issues facing children, while also failing to address child sexual exploitation adequately on its platforms. With this recent order, Meta’s total liability in this case has now reached $942 million.
Out of the $567 million awarded, $420 million will be allocated to mental health treatment services specifically for young people residing in New Mexico. The rest of the funds are intended to support a range of initiatives over the next five years, including prevention and awareness programs, screening services, and other related measures. This ruling also mandates Meta to enhance safety protocols for children on Facebook and Instagram by improving age-assurance systems, offering clearer information about safety and privacy tools, and developing methods to identify users potentially under the age of 13.
Additionally, Meta is required to collaborate with schools or child-safety organizations to establish a system for reporting accounts suspected of being operated by children under the age of 13. The company must also remove any personal information collected from users below this age threshold and is required to provide biannual reports on its compliance with the court’s directives. However, the court decided against enforcing universal age verification solely in New Mexico, citing concerns about fairness and existing federal privacy protections for children.
Meta has expressed its disagreement with the ruling and has announced plans to appeal. The company insists that it is committed to user protection and has been actively working to tackle harmful content and safety issues online. This case is part of a broader set of legal challenges facing Meta, as similar lawsuits are underway in other states across the United States, focusing on the potential harmful effects its platforms may have on younger users.
